These Terms of Use ("Terms") govern your access to and use of the Nail It mobile application ("App," "Nail It," "we," "us," or "our"), operated by Eagle Ridge Tech LLC ("Company"). By downloading, installing, accessing, or using Nail It, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree, do not use the App.
By creating an account, downloading the App, or otherwise using Nail It, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), have the legal capacity to enter into these Terms, and agree to comply with all applicable laws.
If you are using Nail It on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Nail It is a do-it-yourself ("DIY") home project planning application designed for homeowners. Features include:
Nail It is intended for personal, non-commercial use by homeowners. It is not designed for licensed contractors, professional builders, or commercial construction operations.
ALL AI-GENERATED CONTENT WITHIN NAIL IT IS PROVIDED FOR INFORMATIONAL AND PLANNING PURPOSES ONLY. This includes, without limitation: AI-generated renders/previews, build plans, materials lists with cost estimates, tools lists, step-by-step instructions, permit recommendations, contractor handoff briefs, and Ask Nail It chat responses.
You acknowledge and agree that:
Nail It makes no warranties regarding the accuracy, completeness, reliability, or suitability of any AI-generated content for any specific purpose.
HOME IMPROVEMENT PROJECTS CARRY INHERENT RISKS, INCLUDING RISK OF PERSONAL INJURY, PROPERTY DAMAGE, AND FINANCIAL LOSS. By using Nail It, you expressly acknowledge and agree that:
You agree that the Company shall not be liable for any injury, damage, loss, or harm arising out of or related to any project undertaken using information from Nail It.

Nail It may flag projects that commonly require permits, but these flags are informational only and do not constitute a determination of whether your specific project requires permits. Always verify with your local building department.
YOU SHOULD ALWAYS HIRE A LICENSED PROFESSIONAL FOR THE FOLLOWING TYPES OF WORK:
Even if Nail It provides instructions for these types of work, you should not perform them yourself unless you are properly trained, licensed, and authorized to do so. Improperly performed safety-critical work can result in serious injury, death, fire, electrocution, gas leaks, structural failure, and substantial property damage.
Nail It does not provide a marketplace for hiring contractors, does not refer or recommend specific contractors, and does not vet, endorse, or guarantee the work of any third party. The contractor handoff feature simply formats your project information into a brief you can share with contractors of your own choosing. Any agreement between you and a contractor is solely between you and that contractor.

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for extended periods, or are used for fraudulent or abusive purposes.
Subscription Tiers. Nail It offers a free tier with limited features and a paid Pro subscription with the following pricing:
Pricing is subject to change. Any price changes will not affect existing active subscriptions until renewal.
Auto-Renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID or Google Play account will be charged for the renewal at the then-current price.
Cancellation. You may cancel your subscription at any time through your Apple ID or Google Play subscription settings. Cancellation takes effect at the end of the current billing period. No refunds or credits are issued for partial billing periods.
Render Packs. Render packs are non-refundable consumable purchases. Purchased render credits do not expire and carry over month to month, but are forfeited if your account is terminated.
Free Tier. Free users receive a limited lifetime allotment of AI features. Free tier limits do not reset and are not refundable or transferable.
Refunds. All refund requests are subject to Apple App Store or Google Play Store policies. We do not directly process refunds for in-app purchases.
Your Content. You retain all ownership rights in the content you upload to Nail It, including photos, project descriptions, notes, and other user-generated content ("User Content"). By uploading User Content, you grant Eagle Ridge Tech a worldwide, non-exclusive, royalty-free license to use, store, process, display, and modify your User Content solely for the purpose of providing and improving the App's services to you.
AI-Generated Outputs. You may use AI-generated outputs (renders, plans, briefs, etc.) for your personal, non-commercial home improvement projects. AI outputs are generated based on third-party AI services and may be subject to those services' terms of use.
Our Property. The Nail It app, including its design, code, branding, logos, and all underlying technology, is owned by Eagle Ridge Tech LLC and protected by intellectual property laws. You may not copy, modify, reverse engineer, redistribute, or create derivative works of the App without our written permission.

Nail It uses third-party services including but not limited to OpenAI, Anthropic, Supabase, RevenueCat, and Apple/Google in-app purchase systems. Your use of the App is also subject to the applicable terms and policies of these third-party providers. We are not responsible for the availability, performance, or content of third-party services.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE APP AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EAGLE RIDGE TECH LLC OR ANY OF ITS OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Eagle Ridge Tech LLC, and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination:
You may terminate your account at any time by contacting us or using the in-app account deletion option.
We may update these Terms from time to time. Material changes will be communicated through the App or via email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. The "Last Updated" date at the top of these Terms indicates when they were last revised.
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved in the state or federal courts located in Utah County, Utah, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eagle Ridge Tech regarding your use of Nail It and supersede all prior agreements and understandings.
