These Terms of Use ("Terms") govern your access to and use of the IntuiPlate mobile application ("App," "IntuiPlate," "we," "us," or "our"), operated by Eagle Ridge Tech LLC ("Company"). By downloading, installing, accessing, or using IntuiPlate, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree, do not use the App.
By creating an account, downloading the App, or otherwise using IntuiPlate, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), have the legal capacity to enter into these Terms, and agree to comply with all applicable laws.
IntuiPlate is a personal food accountability and wellness tracking application. Features include:
IntuiPlate is intended for personal wellness awareness and food accountability. It is not a medical device, clinical nutrition tool, or substitute for professional medical or dietary advice.
ALL CONTENT WITHIN INTUIPLATE, INCLUDING AI-GENERATED FOOD SCORES, CALORIE ESTIMATES, INSIGHTS, AND WEEKLY COACHING SUMMARIES, IS PROVIDED FOR INFORMATIONAL AND PERSONAL ACCOUNTABILITY PURPOSES ONLY.
You acknowledge and agree that:
IntuiPlate makes no warranties regarding the accuracy, completeness, or suitability of any content for any specific health or dietary purpose.
IntuiPlate is a consumer wellness app and is not a medical device as defined by the U.S. Food and Drug Administration or equivalent regulatory bodies. Do not use IntuiPlate as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or dietary needs.
An account is required to use IntuiPlate. Sign in with Apple is used for authentication. You agree to:
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or abusive purposes.
Subscription Tiers. IntuiPlate offers a free tier with core features and a paid Pro subscription with the following pricing:
Pricing is subject to change. Any price changes will not affect existing active subscriptions until renewal.
Auto-Renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged for the renewal at the then-current price.
Cancellation. You may cancel your subscription at any time through your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period. No refunds or credits are issued for partial billing periods.
Refunds. All refund requests are subject to Apple App Store policies. We do not directly process refunds for in-app purchases.
Free Tier. Free users have access to core food logging, unlimited history, manual body metric entry, and basic accountability features. AI-powered features, HealthKit sync, advanced insights, and custom settings require a Pro subscription.
IntuiPlate uses Anthropic's Claude API to power the AI food scan feature, calorie estimation, and weekly insight generation. You acknowledge that:
We are not responsible for decisions you make based on AI-generated content within IntuiPlate.
IntuiPlate Pro can read weight, body fat percentage, and sleep data from Apple Health with your permission. You acknowledge that:
You retain ownership of the data you enter in IntuiPlate, including food entries, body metrics, and personal goals. By using IntuiPlate, you grant Eagle Ridge Tech a worldwide, non-exclusive, royalty-free license to store, process, and display your data solely for the purpose of providing the App's services to you. We do not use your personal food or health data for advertising or sell it to third parties.
You agree not to:
IntuiPlate uses third-party services including Anthropic, Supabase, RevenueCat, and Apple in-app purchase systems. Your use of the App is also subject to the applicable terms and policies of these third-party providers. We are not responsible for the availability, performance, or content of third-party services.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE APP AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EAGLE RIDGE TECH LLC OR ANY OF ITS OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR PERSONAL INJURY, HEALTH OUTCOMES, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Eagle Ridge Tech LLC, and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of the App, your violation of these Terms, or your violation of any law or third-party rights.
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination your right to use the App ends immediately. You may request deletion of your account and data at any time by contacting us.
We may update these Terms from time to time. Material changes will be communicated through the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. The "Last Updated" date at the top of these Terms indicates when they were last revised.
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved in the state or federal courts located in Utah County, Utah, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eagle Ridge Tech regarding your use of IntuiPlate and supersede all prior agreements and understandings.
