Gather App — Eagle Ridge Tech LLC

By downloading, installing, or using Gather ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.
Gather is a people-counting application available in a free tier and a paid Pro tier. The free tier provides manual counting features. The Pro tier adds AI-powered photo estimation, unlimited session history, CSV export, and capacity tracking. Features may be updated, modified, or removed at our discretion.
Gather Pro is available as an annual subscription at $14.99/year. A 7-day free trial is included for new subscribers. Subscriptions are billed through the Apple App Store or Google Play Store and are subject to the respective store's terms and billing policies. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's subscription settings.
The AI estimation feature provides approximate people counts based on photo analysis. Estimates are not guaranteed to be accurate. The feature is intended as an assistive tool and should not be relied upon for safety-critical decisions, legal compliance, or official capacity reporting. AI photo estimations are limited to 50 per month per subscriber. This limit resets monthly.
You agree not to use Gather to: violate any applicable law or regulation; infringe on the rights of others; submit photos containing illegal content to the AI estimation feature; attempt to reverse-engineer, decompile, or tamper with the App; or circumvent subscription restrictions or usage limits.
Gather, including its design, code, and branding, is the property of Eagle Ridge Tech LLC. Your session data and exported files belong to you.
Gather is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI estimates will be accurate. To the fullest extent permitted by law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Eagle Ridge Tech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Gather. Our total liability for any claim related to the App shall not exceed the amount you paid for your subscription in the twelve months preceding the claim.
We may suspend or terminate your access to Gather at any time for violation of these terms. Upon termination, your right to use the App ceases. Locally stored data remains on your device.
We may update these terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the updated terms.
These terms are governed by the laws of the State of Utah, without regard to conflict of law principles.
