These Terms of Use ("Terms") govern your access to and use of the DugoutPulse mobile application and website (collectively, the "Service") operated by Eagle Ridge Tech LLC ("we," "our," or "us"). By using the Service, you agree to these Terms.
You must be at least 18 years old to create an account and use the Service. The Service is designed for adults — including coaches, parents, grandparents, family members, and friends — who wish to track youth baseball games. The Service is not intended for use by minors.
To access certain features, you must create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
DugoutPulse offers a free tier and two paid subscription plans:
Subscriptions are billed annually through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your Apple ID account settings.
If a free trial is offered, the trial period will be specified at the time of subscription. You will not be charged during the free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
You agree to use the Service only for its intended purpose: tracking and managing youth baseball games. You agree not to:
You retain ownership of all data you enter into the Service, including player names, game data, team information, and statistics ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely to provide the Service to you. We do not use your User Content for advertising, marketing, or any purpose unrelated to providing the Service.
The Service uses AI technology to generate post-game insights and analysis. AI-generated content is provided for informational and entertainment purposes only. It should not be relied upon as professional coaching advice or medical guidance. We make no warranties regarding the accuracy or completeness of AI-generated content. Always consult qualified professionals for medical or training decisions related to young athletes.
When you share a live game link, you acknowledge that the game information (scores, pitcher names, batter names, and play-by-play data) will be accessible to anyone with the link. You are responsible for controlling the distribution of your live game links. We are not responsible for any consequences arising from your decision to share a game link.
The Service, including its design, code, features, graphics, and content (excluding User Content), is owned by Eagle Ridge Tech LLC and protected by intellectual property laws. The DugoutPulse name and logo are trademarks of Eagle Ridge Tech LLC. You may not copy, modify, distribute, or reverse engineer any part of the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
PITCH COUNT LIMITS, REST DAY CALCULATIONS, AND AGE GROUP RULES PROVIDED BY THE SERVICE ARE BASED ON COMMON LEAGUE GUIDELINES AND ARE FOR REFERENCE ONLY. IT IS THE RESPONSIBILITY OF THE COACH, PARENT, OR GUARDIAN TO VERIFY AND COMPLY WITH THEIR SPECIFIC LEAGUE'S RULES AND REQUIREMENTS. WE ARE NOT RESPONSIBLE FOR ANY INJURY, PENALTY, OR CONSEQUENCE RESULTING FROM RELIANCE ON THE SERVICE'S PITCH LIMIT OR REST DAY FEATURES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAGLE RIDGE TECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR PERSONAL INJURY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Eagle Ridge Tech LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time through the Settings screen in the app. Upon termination, your right to use the Service ceases immediately.
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Utah County, Utah.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app or Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
